Forget small-time operators like Levi's, Heinz and Bacardi - what this
opens up is the possibility of Cuba exporting Microsoft Windows as a
free download via the internet. That is the real danger to corporate
America and it would result in an IMMEDIATE reversal of US State
Department directive in the Bacardi case. But even "immediate" might
not be quick enough to save the US economy.

Exporting goods you have to physically manufacture and transport would
take time and resources, but Cuba already has a software writing
industry with a global reach. They can even take their time to
establish a network of secure download sites around the globe whilst the
appeal hearing winds its way through the US courts.

Cuban technicians have been rewriting the Windows operating system to
run on lower powered recycled computers for well over a decade. They
know the Windows code inside out. And by all accounts, the Cuban
version is more stable, uses less power and can be run on cheaper
processors. And because they have re-engineered parts of the code, it is
even rumoured to be virus-free. Now that's a buying opportunity that
would set the computing world on fire.

10 seconds after the final decision on the appeal upholds the US State
Department's power to direct the extinguishing of an internationally
recognised trademark within the USA, a one-word email (sent from a
hospital bed, perhaps) could activate hundreds of download sites
offering the free Windows operating system. Before Bill Gates could
even brief his lawyers, Microsoft would be history.

How could a US court make such a decision? Easy, just look at how they
can set aside 50 years of established international law in relation to
torture. The US Constitution, as interpreted by the current neo-con US
Supreme Court, has established a new planet - The Holy planet of
God-fearing America. This new planet has its own self-referencing legal
system that recognises no rights but those of crusading US imperialism.

In a trademark dispute between Microsoft and Bacardi, there'd be only
one winner ... Cuba. And the biggest loser would be America Inc.
